Bill Title

An act concerning home and community based services and supplementing P.L.1968, c.43: S875

New Jersey

Medicaid Waivers
Passed 08/02/2022

Description

P.L.2022, c.84, requires the Division of Medical Assistance and Health Services within the Department of Human Services to accept a permanent change of station order to a duty location located in New Jersey. Under the law, any branch of the United States military can issue a permanent change of station order to the parent or legal guardian of an applicant, for the purposes of satisfying the residency requirement for the provision of home and community-based services reimbursed by the Medicaid program. Home and community-based services make it possible for eligible individuals to receive services in their own homes and communities rather than in institutions. The Community Care Program was originally approved by the Centers for Medicare and Medicaid Services in 1985 to provide a community-based alternative to institutional care. These programs serve a variety of targeted populations groups, such as people with intellectual or developmental disabilities, physical disabilities, and/or mental illnesses.
