State Employment Protections


Key Message

State statutes that cover National Guard members during state-sponsored mobilizations impact employers within the state. States can modify their statutes to strengthen enforcement mechanisms for members of the guard returning to jobs in their affiliated state and protect the employment rights of members of the guard who are employed outside of their affiliated state at the time of state-sponsored activations.


States can strengthen job protections for National Guard members who are called to serve in or outside of their state.


Every state has a law that protects the civilian jobs of National Guard members called for local emergencies such as fires and floods. However, some states need to strengthen legal enforcement for violation of these guarantees and to protect the jobs of activated guard members who work in other states.
