AL constitution Article I Section 31 establishes that temporary absence from the state does not terminate status as a state resident. According to Associate Commissioner Courtney Tarver, constitutionally, the resident must remain eligible to apply for, or keep services, even if located out of state in the military. However, criticality of need still remains the overriding factor in driving the waiting list priorities. Service would resume or start upon return to the state, once attaining #1.
