Military Clause in State Family Leave Laws Final Legislation
Nebraska Revised Statute 55-502, et seq, The Nebraska Military Family Leave Act, creates a state-level expansion of federal FMLA because it applies to smaller employers, those with 15+ employees, whereas federal FMLA only applies to employers with 50+ employees. Employers with 15-50 employees shall provide up to 15 days of unpaid family military leave. Employers with 50+ employees shall provide up to 30 days of unpaid family military leave. The law also covers state-level activations and someone who is "called to military service". The call to military service must be 179+ days.
