Military Clause in State Family Leave Laws Final Legislation
FMLA leave is available to eligible employees for the following reasons: For a qualifying exigency arising out of the fact that an eligible employee's spouse, child or parent is a covered military member on "covered active duty;" and/or, to care for a covered service member with a serious injury or illness if the employee is the spouse, child, parent or next of kin of said service member. (Note: Under this provision, eligible employees may take up to 26 weeks in a 12 month period; and, additional leave may be available under the Rhode Island Military Leave Act.)
